BASIC CONTRACT OF THE PROJECT "ADOPT TREES"

BASIC PARTNERSHIP, SERVICES AND SUNDRIES CONTRACT PERTAINING TO THE PROJECT "ADOPT TREES" AS SPECIFIED HEREUNDER.

By means of this legal contract the following terms are thus defined:

FOUNDATION: ENVIRONMENTAL FOUNDATION JOSÉ REBELO DO XINGÚ (FUNDAÇÃO AMBIENTAL JOSÉ REBELO DO XINGÚ) is a non-profit legal entity of private law with head office located at Rua Marechal Assunção, s/n°, sala 01, Bairro Centro, in the Municipal District of Senador José Porfírio, State of Pará.

GOALS OF THE FOUNDATION:

1. The Foundation's objective is to contribute both to the conservation and environmental improvement of the Amazon region, and to the region's sustainable development. On these lines, it may suggest, promote, coordinate or carry out missions and projects in its own land or in third party properties with a view to:

I. defend the Amazonian environment, in particular the flora, fauna and biodiversity, as well as the standards of living of the region's inhabitants through the utilization of the available economic, scientific, educational, and legal mechanisms, including civil legal action;

 

II. provide the means for the sustainable use of the Amazon's natural resources, in order to obtain the maximum benefit for existing populations and future generations;

 

III. ensure the means for the conservation of the water resources of the Brazilian Amazon;

 

IV. seek alternative and creative means for the overcoming of misery in the region, considering the principle of shared responsibility between all the planet's inhabitants who directly or indirectly benefit from the existence and preservation of the Amazon forest;

 

V. the establishment of protected areas and conservation units;

 

VI. promote studies and scientific research on the natural resources of the Amazon for their adequate utilization;

 

VII. Spread awareness of the importance of the preservation of nature as an instrument for the survival of human beings by stimulating environmental education at all levels;

 

VIII. disseminate practices and conservation techniques in the region;

 

IX. promote the training of human resources;

 

X. promote, carry out and stimulate the realization of Environmental Impact Statements relating to the anthropic activities in the region as a means to prevent environmental damage;

 

XI. promote Ecotourism as an instrument of sustainable development;

 

XII. support public or private organizations dedicated to the protection of the environment and human quality of life;

 

XIII. stimulate and promote exchanges with national or international university, scientific and research institutions dedicated to the conservation of nature and the promotion of sustainable development.

ON THE TECHNICAL AND ADMINISTRATIVE STRUCTURE OF THE FOUNDATION:

ON THE CONTRACTING PARTIES:

Granting partner: Holds the right of use over the land areas located in Portel and Senador José Porfírio, Pará.

Acceding Partner: will request the adoption of a tree.

ON THE TERMS OF THE ADOPTION:

Although in the civil code the term 'adoption' relates only to human persons, in the present contract 'adoption' will used in order to define the rights and obligations between contracting parties, in light of the objectives laid down herewith.

The contracting parties declare and expressly agree on the following provisions:

1. The Foundation owns, through a grant of rights over a tract of 500 ha of land located in a real property denominated AGROPECUÁRIA COLORADO DO NORTE, registered in the INCRA under number 045071993239-3, and located in the Municipal Districts of Portel e Senador José Porfírio, Estado do Pará.

 

2. The Foundation prepared a project denominated " adopt trees" with details and other particulars spelled out in a separate document which is, notwithstanding, to all effects and purposes of law, considered as part of the present document as though hereby written.

 

3. The Foundation, here denominated Granting Partner, grants and transfer its rights to the Aceeding Partner,regarding the acquisition of a tree of the ………………………. type, and the ……………… botanic family, as specified in the lists which are, for all effects and purposes, integral part of the present document.

And for deeming them fair, agreed upon and settled by formal agreement, the contracting parties subscribe the present accession contract in 02 (two) exact copies of equal content and form, and with a single purpose.
